1. Company Identity & Governing Framework

This website (brixenvault.com) is operated by Brixen Vault, based in Lucca, Italy. By accessing our platform or placing an order, you agree to be bound by these Terms of Service. These terms are governed by Italian law, including the Italian Consumer Code (Legislative Decree 206/2005) and E-Commerce Decree (Legislative Decree 70/2003), alongside applicable European Union consumer regulations.

 

2. Order Formation & Pre-Order Terms

• Contract Binding: An order submission constitutes an offer to purchase. A legally binding sales contract is formed only when Brixen Vault issues a formal dispatch confirmation email containing tracking credentials.

• Pre-Orders & Event Exclusives: Pre-orders for upcoming import graphic novels or conventions (e.g., Lucca Comics & Games) exclusives require full payment at checkout to secure distributor allocations. Estimated release dates are provided by publishers and are subject to production or logistics delays beyond our control.

• Pricing & Typographical Errors: We reserve the right to cancel and fully refund any order arising from clear administrative or system errors in display pricing prior to shipment.

 

3. Currency, Taxes & International Import Duties

• Multi-Currency Settlement: Display prices in non-EUR currencies via Shopify Markets are estimations based on real-time rates; final checkout charges reflect the selected currency rate at transaction time.

• Import VAT & Tariff Duties: For orders dispatched outside the European Union (including shipments to US addresses or UK collectors), the buyer acts as the importer of record. You are solely responsible for any local customs duties, import VAT, or clearance fees levied by destination authorities.

 

4. Shipping, Delivery & Freight Forwarding

• Transfer of Risk: Risk of loss and damage transfers to the buyer upon courier delivery confirmation to the shipping address provided at checkout.

• Freight Forwarder Liability: Delivery to a third-party freight forwarding facility completes our shipping contract. Brixen Vault is not liable for loss, mishandling, or transit damage occurring after a freight forwarder receives and signs for the shipment at their warehouse.

 

5. Statutory Returns & Non-Returnable Artifacts

• EU Consumer Withdrawal: European Union residents retain a statutory 14-day right of withdrawal from physical delivery. Returned items must remain factory-sealed in original shrink-wrap; unsealed or handled volumes are subject to a diminished value deduction up to 100%.

• Final Sale Items: All custom items, including 3D-printed components, bespoke accessories, and laser-engraved pieces, are manufactured on a made-to-order basis. These creations are strictly Final Sale once production begins, except in cases of verified transit damage.

 

6. Jurisdiction & Dispute Resolution

These Terms are governed by the laws of Italy. Any legal disputes or claims arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Lucca, Italy, without affecting mandatory statutory rights guaranteed to EU consumers in their country of residence.
